Terms of Service
Last updated: October 10, 2026. By using Valotrace you agree to these terms.
1. Agreement
These Terms govern access to and use of the Valotrace website, dashboard, APIs, and SDKs (the "Service") provided by Valotrace ("we", "us"). If you use the Service on behalf of a company, you confirm you have authority to bind it, and "you" means that company. If you do not agree, do not use the Service. Our Privacy Policy is part of these Terms.
2. The Service
Valotrace helps mobile game studios create, send, and measure messages to their players, with each send assigned against a holdout so lift can be measured. Channels differ in availability: some are live, others are in development or announced. Only channels shown as available in the product are provided. Features described as upcoming are not commitments.
3. Accounts and security
- Accounts are issued to named individuals. Keep your credentials and API keys confidential and do not share them.
- You are responsible for activity under your account and keys. Tell us promptly if you suspect unauthorized use.
- Provide accurate information and keep it up to date.
4. Your responsibilities for messaging
You control what is sent and to whom. You are solely responsible for:
- Having a lawful basis and all required consents and notices for every player you message, including opt-in for push, email, or SMS under laws such as the CAN-SPAM Act, TCPA, GDPR, and ePrivacy rules.
- Honoring opt-outs and platform rules, including Apple's and Google's push notification requirements.
- The content of your messages, including AI-suggested variants. Suggestions are drafts. Review them before approving.
- Your own provider accounts and credentials, and any fees charged by those providers.
- Complying with children's privacy laws if your game is directed to or knowingly used by children.
Valotrace does not currently enforce frequency caps or quiet hours at send time. You are responsible for sending at appropriate times and volumes.
5. Acceptable use
You may not use the Service to:
- send spam, deceptive, harassing, unlawful, or infringing content;
- message people who have not agreed to receive your messages where consent is required;
- probe, scan, or test the vulnerability of the Service, or access another customer's data or apps;
- interfere with or overload the Service, or circumvent limits or security controls;
- reverse engineer the Service except where the law permits, or use it to build a competing product;
- use real or fake device tokens in a way that violates provider terms.
We may suspend or restrict access immediately if we reasonably believe these rules are being broken or the Service is at risk.
6. Experiments and measurement
Lift results are statistical estimates, shown with intervals and sample sizes. They are not guarantees of future performance. Holdout groups are essential to valid results; deliberately removing or bypassing holdouts will make measurements unreliable. Decisions you make based on results, including any pricing, sale, or product decisions, are yours.
7. Your data
You keep all rights to the data and content you submit ("Customer Data"), including player data. You grant us a limited license to host, process, and transmit it only to provide and secure the Service, as described in the Privacy Policy. You confirm you have the right to provide it. Where required by law, our Data Processing Agreement applies to personal data we process for you, and we will countersign it on request.
You may export your data and request deletion by contacting us. We may use aggregated, de-identified data that does not identify you or any player to operate and improve the Service.
8. Our intellectual property
We and our licensors own the Service, including software, models, design, and documentation. We grant you a limited, non-exclusive, non-transferable, revocable right to use it during your agreement for your internal business purposes. If you give us feedback, we may use it without restriction or payment.
9. Third-party services
The Service works with third-party services such as Apple Push Notification service and AI model providers. They are governed by their own terms, and we are not responsible for their availability or actions.
10. Fees
Fees, if any, are described in your order form or in the product. Unless stated otherwise, fees are billed in advance in US dollars, are non-refundable, and exclude taxes. We will give notice before changing prices for an existing term.
11. Term and termination
These Terms apply while you use the Service. You may stop at any time. We may suspend or terminate access for breach, non-payment, legal requirements, or risk to the Service. On termination your right to use the Service ends, and we will handle Customer Data as described in the Privacy Policy. Sections that by their nature should survive (including 7 to 8 and 12 to 15) will.
12. Disclaimers
The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted or error-free, that messages will be delivered, or that any experiment will produce a particular result.
13. Limitation of liability
To the fullest extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill. Our total liability for all claims relating to the Service will not exceed the greater of the amount you paid us in the 12 months before the claim or US$100. Some jurisdictions do not allow certain limits, so these may not fully apply to you.
14. Indemnity
You will defend and indemnify us against third-party claims, and resulting losses and reasonable costs, arising from your Customer Data, your messages, your violation of law or these Terms, or your failure to obtain required consents.
15. Governing law and disputes
These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-law rules. The state and federal courts located in San Francisco County, California have exclusive jurisdiction, and each party consents to them. Before filing a claim, each party agrees to try to resolve the dispute informally by written notice for at least 30 days.
16. Changes
We may update these Terms. For material changes we will give notice by email or in the product, and the update takes effect on the date stated. Continued use after that date means you accept the changes.
17. General
These Terms and any order form are the entire agreement between us on this subject. If a provision is unenforceable, the rest remains in effect. You may not assign these Terms without our consent; we may assign them in a merger or sale. Failure to enforce a provision is not a waiver. Neither party is liable for delays caused by events beyond its reasonable control.
